WARRANTY

Perfect Switch LLC and Mobile Welding & Power "the company", warrants the MOBI-ARC and POWER-GATE line of products against all defects in materials and workmanship for a period of one year from the date of the original purchase, subject to the following terms and conditions:


This warranty does not apply if the serial number or housing of the product has been removed, or if the product has been subjected to physical abuse, improper installation, water damage, corrosion due to road salts or de-icing chemicals, or modification.


To obtain warranty service, please contact the manufacturer for a Return Materials Authorization (RMA) number. The product must be returned, insured and shipping prepaid, to Mobile Welding & Power, at the address below, in its original packaging or a suitable equivalent, along with a written description of the problem.


The company's responsibility under this warranty is limited to repair or replacement of the product or refund of its purchase price, at the sole discretion of Mobile Welding & Power.


The company disclaims all other warranties, expressed or implied, including warranties of merchantability and fitness for any particular purposes whatsoever, and no other remedy shall be available including without limitation, incidental or consequential damages. In no event shall the company's liability exceed the purchase price of the product in question.


Some states do not allow the exclusion or limitation of incidental or consequential damages of how long an implied warranty lasts, so the above limitations or exclusions may not apply to you.


This warranty gives you specific rights. You may have other legal rights which may vary from state to state.

SHIPPING TERMS
Unless otherwise stated, freight and shipping fees will be charged for shipments to a purchaser's home or place of business using a carrier of our choice. Any extra charges incurred for additional services, such as customer's carrier or special handling by the carrier, must be paid by the consignee. Title and risk of loss pass to the customer upon tender of shipment to the carrier. If product is damaged in transit, consignee must contact the Mobile Welding & Power (MWP) and file claim with the carrier.

Unless varied herein, shipping terms are FOB (as defined by International Chamber of Commerce Terms in effect at the time of order acceptance) closest U.S. airport or port of exit from MWP shipping warehouse, except Alaska, Hawaii and Puerto Rico, using local shipping point and routing of MWP’s choice. Purchaser shall be responsible for obtaining insurance. At MWP’s option, freight policy for certain export orders may be subject to special terms and conditions. Title and risk of loss shall pass to Purchaser on delivery to the international carrier in the United States provided that if payment has not been made at the time of shipment MWP shall retain title (but not risk of loss) until payment has been made. If product is damaged in transit, Purchaser must notify MWP and file claim exclusively with airline, carrier, vessel and/or insurance company.

We will ship Purchaser orders airfreight at Purchaser’s expense if preferred.

Merchandise is carefully packed in compliance with carrier requirements. The customer must make claims for loss and damage in transit with the carrier. All shipments should be unpacked and inspected immediately upon receipt. All claims for shortage, shipment errors, or damage should be made within 10 days after receipt of shipment.

PAYMENT TERMS

For your convenience we accept the following methods of payment: Visa, Master Card, American Express, Discover cards and wire transfers. For purchasers with established credit, terms are net twenty (20) days from date of shipment. All payments must be made in United States Currency. If Dealer fails to make payment within twenty (20) days, MWP has the option to defer shipments until such payment is made, or may, at its option, cancel all or any part of unshipped order. Finance charges on the unpaid balance will be charged as stipulated on the original invoice.
